When a Contractor is covered under the ambit of any enactment then, such Contractor is compulsorily required to comply under such enactment. Similarly if such a Contractor is covered under the Employees' Provident Funds and Miscellaneous Provisions Act, 1952, then he is under an obligation to adhere to the provisions of the Act and register himself under it, as failing in doing so will cause violation of the provisions and denial of benefits of eligible employees that they are assured under the Act. Therefore, it is very necessary to make sure that all the eligible employees receive their benefits as prescribed under the Act.

In this regard, the Central Analysis & Intelligence Unit of the Employees' Provident Fund Organization has decided to gather the statistics and information about all the Contractors so that the same could be verified or crosschecked with the existing information and on the basis of such information inspections could be conducted by the Inspectors to determine the defaulters among such contractors so that:

1.       the Act could be imposed upon such contractors; and

2.       the liability if due could be recovered from them; and

3.       it could be ensured that all the eligible employees are given their benefits as prescribed under the said Act

Therefore, the Central Analysis & Intelligence Unit of the Employees' Provident Fund Organization has issued a Circular No CAIU/011(33)2015/HQ, dated 7^th March 2016, suggesting that every Principal Employer shall be made to upload the information and details of their respective Contractors in the manner as may be prescribed under the said Circular
